Ascend‑Funded LLC (“Ascend‑Funded,” “we,” “our,” or “us”) provides access to a proprietary trading simulation and evaluation platform through which users (“you,” “your,” “participant,” or “trader”) may engage in simulated trading challenges and assessments. By accessing, registering for, or using our Services, you agree to be bound by these Terms of Service (“TOS”).

1. Nature of Services

1.1. Simulation-Only Platform
Ascend‑Funded provides a purely educational and simulated trading environment. All trading accounts, market data, capital, profits, losses, certificates, or any form of “payouts” or “funding” are entirely simulated and not real. No real money is ever traded or exchanged.

1.2. No Financial Services
Ascend‑Funded is not a broker-dealer, financial advisor, investment fund, or any other regulated financial entity. We do not offer real trading accounts or engage in actual asset or capital management.

1.3. Educational and Evaluative Purpose
Our services are designed solely for skill development, entertainment, and evaluation. Any resemblance to real trading is coincidental and strictly simulated.

2. Use of Services

2.1. Eligibility
You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher, and capable of entering into binding legal agreements.

2.2. One Account per User
Each user may register only one account. Multiple accounts by the same individual may be terminated without notice.

2.3. Non-Transferability
Accounts and associated challenge access are non-transferable. Use of your account by any other party is prohibited and constitutes grounds for immediate termination.

3. Simulated Payouts and Certificates

3.1. Non-Guaranteed Payouts
Ascend‑Funded may offer simulated “payouts” or “profit splits” as part of the platform experience. These do not represent real monetary compensation or legally enforceable payment rights.

3.2. Discretionary Rewards
All rewards, including but not limited to certificates, achievements, funding offers, and simulated payouts, are entirely discretionary. Ascend‑Funded reserves the right to withhold, revoke, or cancel any such rewards for any reason or no reason, at any time.

3.3. No Claim of Compensation
You explicitly waive any and all claims to compensation, payments, or entitlement to receive money in exchange for performance on any challenge or evaluation.

3.4. Certificates are Simulated
Any “certificates,” “badges,” or other recognitions of achievement are not formal licenses, authorizations, or credentials and are provided for entertainment or motivation purposes only.

4. Fees & Payments

4.1. Evaluation Fees
Fees for challenge entry or simulation access are displayed on our website and must be paid prior to participation. All prices are in the currency specified at checkout.

4.2. No Refund Policy
All purchases are final and non-refundable, regardless of performance, disqualification, or account termination.

4.3. Chargeback Prohibition
By purchasing a service, you agree not to initiate chargebacks or payment disputes. Unauthorized chargebacks may result in account suspension, debt collection, and reporting to fraud monitoring services.

5. Challenge Rules & Compliance

5.1. Challenge Parameters
Challenge conditions (such as profit targets, drawdown limits, time restrictions, etc.) are disclosed during sign-up. Failure to comply results in disqualification.

5.2. No Automated or Exploitative Trading
Use of bots, external trading APIs, copy-trading, arbitrage techniques, latency exploitation, or otherwise manipulative tactics is strictly prohibited.

5.3. Monitoring and Logging
All activity is logged and subject to review. We reserve the right to disqualify or terminate users who engage in suspicious, abusive, or exploitative behavior.

6. Funded Accounts (Simulated)

6.1. No Guarantee of Funding
Completion of a challenge or assessment does not entitle you to a real or simulated funded account. Ascend‑Funded is under no obligation to provide any real or simulated trading account, regardless of your performance.

6.2. Simulated Funded Stage
Any reference to a “Funded Account” refers to a continuation of simulation, possibly under different rules or drawdown structures, and does not represent the provision of real trading capital.

6.3. Termination of Funded Status
We may revoke access to any funded stage, with or without cause, including for strategy concerns, policy violations, or internal reviews.

7. Intellectual Property

7.1. Ownership
All content, technology, branding, and data on the Ascend‑Funded platform are protected under applicable intellectual property laws.

7.2. Limited License
You are granted a non-exclusive, non-transferable license to access our platform solely for personal use and in compliance with this TOS.

8. Limitation of Liability

8.1. No Warranties
Services are provided “as is” without warranties of any kind, express or implied. We disclaim all warranties including fitness for a particular purpose, merchantability, and non-infringement.

8.2. No Responsibility for Losses
We are not responsible for financial losses, loss of data, opportunity cost, or personal outcomes resulting from use of the simulation platform.

8.3. Liability Cap
In any jurisdiction allowing limitations, our liability is limited to the total amount you paid to Ascend‑Funded in the past 6 months.

9. Termination

We may suspend or terminate your access for any reason, including suspected fraud, abuse, policy violations, or at our discretion.

Termination does not entitle you to any refund or compensation. All access to services and any simulated rewards are forfeited immediately.
